THE IMPORTANCE OF CISG IN INTERNATIONAL TRADE RELATED TO INDONESIAN LAWS

Abstract

Bonding is a vehicle for someone who allows other people to do something or not do something. Basically, no one in this world can force other people to do or not do something except of their own free will. Someone is willing to do something or not do something that the other party wants, of course, for certain reasons and this is first required in the agreement. In a contract that is bound is a person with a person, a legal bond between a person and a person is at least two people. The rights that arise are the rights of a person. International trade is a cross-border buying and selling transaction, which involves two parties buying and selling across national boundaries. These parties are often parties who come from different countries or have different nationalities. The international trading phenomenon raises the possibility of a need for generally applicable laws and regulations that uphold the rights and obligations of all participants in international trade. Legal uncertainty and difficulties among traders in making international trade contracts are already under the contents of national laws which differ from one country to another. In particular, the CISG seeks to balance differences between the civil law and common law . systems of law by establishing rules that apply to international sales of goods (opening of the CISG). The CISG specifies the creation of sales and purchase agreements as well as the obligations of buyers and sellers (including legal remedies for them). CISG officially began on January 1st, 1988 for nations that were considered contenders at the time. The purpose of this study is how are the legal principles contained in cisg, what is the importance of cisg for Indonesia and how is cisg as a legal substance in international buying and selling contracts. This study uses a normative method by sharing sources of books and journals. Currently Indonesia has not implemented cisg in international contracts so it needs ratification because it is considered important.
